Terms of Use

1. About these Terms

These Terms of Use (“Terms”) govern your use of the apps made by NAV LAB — currently Noota, Tempus, Risen, Mona, Visty and Folda — on any Apple device, together with their websites and navlab.app (together, the “Services”). The Services are provided by the developer identified as the seller of our apps on the Apple App Store, who operates NAV LAB (“NAV LAB”, “we”, “us” or “our”).

By downloading, installing or using a Service, you agree to these Terms. If you do not agree, do not use the Service.

  • Our Privacy Policy explains how we handle your personal data.
  • If you downloaded an app from the App Store, Apple’s Licensed Application End User License Agreement (the “Standard EULA”) also applies, and these Terms supplement it.
  • Section 16 adds terms that apply only to particular apps. If a section there conflicts with the rest of these Terms, the app-specific section prevails for that app.
  • Some of our apps’ websites also publish app-specific terms. If they ever differ from these Terms, these Terms apply.

2. Changes to the Services and to these Terms

We regularly improve our apps. We may add, change or remove features for valid reasons, for example to improve a Service, to adapt it to technical or security developments, or to comply with the law. If a change significantly reduces features you have paid for, we will tell you in advance where reasonably possible, and you can cancel your subscription.

We may update these Terms, for example to reflect changes to the Services, to the law or to our business. We will publish the updated Terms on this page and change the “Last updated” date. If a change is significant, we will notify you in the app or by other appropriate means before it takes effect. If you do not agree with the updated Terms, you can stop using the Service and cancel your subscription before they take effect. If you continue to use the Service after they take effect, the updated Terms apply to you.

3. Eligibility and accounts

  • Minimum age. You must be at least 13 years old to use the Services. If you are under 18, or under the age of legal majority where you live, you may use the Services only with the permission of a parent or legal guardian, who must review and accept these Terms on your behalf and who is responsible for your use of the Services, including any purchases.
  • Organizations. If you use a Service on behalf of a company, school or other organization, you confirm that you are authorized to accept these Terms on its behalf.
  • Accounts. Most of our apps work without an account. Where an app offers one (for example, to sync your content), you are responsible for keeping your devices and sign-in methods secure and for the activity that takes place under your account. Tell us promptly at support@navlab.app if you suspect unauthorized access.

4. Acceptable use

You agree not to:

  • use a Service in breach of the law, or to violate the privacy, intellectual property or other rights of others;
  • record, scan, import or process content or personal data without the rights, consents or notices required by law;
  • upload or process illegal content, or content that contains malware or other harmful code;
  • use AI features to create unlawful, deceptive or harmful content, or try to circumvent their safeguards;
  • copy, modify, reverse engineer or decompile a Service, except to the extent applicable law expressly permits it;
  • access a Service with bots, scrapers or other automated means, overload or interfere with our servers or APIs, or try to gain unauthorized access to them;
  • circumvent usage limits, paywalls or other technical restrictions, or resell or commercially exploit a Service without our written permission.

5. Your content

  • Ownership. You keep all the rights you have in the content you create, record, scan or import in our apps (“Your Content”).
  • License to us. Where an app stores or processes Your Content on our servers or through our service providers, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, transform and display it, solely as needed to operate, provide, secure and support that app for you. This license ends when you delete Your Content or your account, except for copies we are required to keep by law and copies that remain for a limited time in backups. Content that stays on your device or in your own iCloud account is not covered, because we never receive it.
  • Your responsibility. You are responsible for Your Content and confirm that you have the rights needed to create, record, scan, import and process it, including content that belongs to or concerns other people.
  • No sale, no AI training. We do not sell Your Content and we do not use it to train AI models.
  • Keep copies. We work to keep Your Content safe, but no service is free of failures. Keep your own copies of anything important, for example by using the export features in the apps.

6. AI features

  • How they work. Some features use artificial intelligence, either on your device or through the third-party AI services named in our Privacy Policy, to create summaries, notes, plans, transcripts, extracted text or other results (“AI Output”).
  • Accuracy. AI Output is generated automatically and may be inaccurate, incomplete or inappropriate. Review it before relying on it, especially for important decisions.
  • Not professional advice. AI Output is not medical, legal, financial or other professional advice.
  • Use of AI Output. As between you and us, you may use AI Output generated from Your Content for any lawful purpose, subject to the rights of third parties in the underlying content. AI Output generated for other users may be similar to yours. You are responsible for how you use it.
  • Availability. AI features may depend on your device, your region, Apple Intelligence being available, or third-party services. They may be temporarily unavailable or limited.

7. Purchases and subscriptions

Free and paid features

Our apps can be downloaded for free and offer optional paid features (“Pro”), as a subscription or, where offered, a one-time purchase. The features, price and any trial or promotional terms of each option are shown in the app before you buy. What is included differs from app to app.

Purchases through Apple

All purchases are made through Apple’s App Store and processed by Apple under Apple’s terms. Payment is charged to your Apple Account when you confirm the purchase. We do not receive or store your payment card details. Prices and taxes may vary by country.

Automatic renewal

Subscriptions renew automatically at the end of each period, at the price then in effect, unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.

Free trials and promotional offers

If a subscription starts with a free trial, it automatically becomes a paid subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. If you buy a subscription at an introductory or promotional price, it renews at the regular price after the promotional period unless you cancel. Eligibility for trials and offers is determined under Apple’s rules and the conditions shown in the app. Any unused part of a free trial ends when you buy a subscription.

Price changes

We may change prices for future subscription periods. Apple will inform you before any price increase and, where required by law or by Apple’s rules, will ask for your agreement. If you do not agree, you can cancel before the new price applies.

Cancelling

You can cancel a subscription at any time in your Apple Account settings (see Apple’s guide: Cancel a subscription from Apple). Cancelling stops future renewals, and you keep access until the end of the period you have already paid for. Deleting an app or its data does not cancel a subscription.

Refunds

Because Apple processes all payments, we cannot issue refunds ourselves. You can request a refund from Apple (see Request a refund); Apple decides on refund requests under its own policies. This does not affect the rights you have under mandatory consumer law, such as the right of withdrawal that applies to consumers in some countries, which Apple handles under its own terms.

Lifetime purchases

Where an app offers a Lifetime purchase, it is a one-time payment that gives you access to that app’s Pro features for as long as we continue to provide that app, and not for your lifetime or the lifetime of a device. Pro features may evolve over time.

Restoring purchases

If you reinstall an app or use a new device, sign in to the same Apple Account and use Restore Purchases in the app.

8. Intellectual property and feedback

The Services, including their software, design, text, graphics, logos and trademarks (but not Your Content), belong to us or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable license to use the Services for your personal or internal business purposes. These Terms do not transfer any ownership rights in the Services to you.

If you send us feedback or suggestions, we may use them freely, without any obligation to you.

9. Third-party services

The Services work with services provided by third parties, such as Apple (the App Store, iCloud, Siri, Apple Intelligence) and Google, as described for each app in our Privacy Policy. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

10. Suspension, termination and discontinuation

  • By you. You can stop using a Service at any time. Where an app has an account, you can delete it in the app; otherwise, deleting the app removes the data it keeps on your device. Remember to also cancel any subscription in your Apple Account settings.
  • By us. We may suspend or terminate your access to a Service if you seriously or repeatedly breach these Terms, if the law requires us to, or to prevent harm to other users, third parties or the Services. Where reasonable, we will tell you in advance, explain why and give you an opportunity to remedy the situation.
  • Discontinuation. We may stop providing a Service or any part of it. If we discontinue an app as a whole, we will give you at least 30 days’ notice in the app or on our website where reasonably possible, so that you can export your content.
  • Effect. Provisions that by their nature are meant to continue after termination, such as Sections 8, 11, 12, 14 and 15, remain in effect. If we discontinue a Service, this does not affect any rights you may have under applicable law regarding amounts you have already paid.

11. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available”. We do not guarantee that they will be uninterrupted, error-free or secure, that content will never be lost, or that any result they produce (including AI Output, recognized text, calculations, reminders and alarms) will be accurate or delivered on time. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.

This does not affect the legal guarantees that apply to you as a consumer, such as the legal guarantee of conformity for digital content and digital services in the European Union.

12. Limitation of liability

  • To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill or data, arising out of or in connection with the Services or these Terms.
  • To the fullest extent permitted by law, our total liability for all claims arising out of or in connection with a Service or these Terms is limited to the greater of (a) the amounts you paid for that Service in the 12 months before the event giving rise to the claim and (b) USD 100.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or willful misconduct, or for any other liability that cannot be excluded or limited under applicable law.
  • Consumers. If you are a consumer and the mandatory law of your country of residence (for example, in the European Union or the United Kingdom) does not allow the exclusions or limitations in Sections 11 and 12, they do not apply to you to that extent, and our liability is determined by that law.

13. App Store terms

If you downloaded an app from Apple’s App Store:

  • These Terms are concluded between you and us only, and not with Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation whatsoever to provide any maintenance or support services for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws.
  • If a third party claims that the app or your possession or use of it infringes that third party’s intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
  • You confirm that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple will have the right to enforce them against you as a third-party beneficiary.

14. Governing law and disputes

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts of your country of residence where that law allows it.

Before starting any proceedings, please contact us at admin@navlab.app so that we can try to resolve the issue amicably.

15. General

  • Entire agreement. These Terms, together with our Privacy Policy, the Standard EULA where it applies, and any conditions shown to you at the time of purchase, form the entire agreement between you and us regarding the Services.
  • Severability. If any provision of these Terms is found invalid or unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions remain in full force and effect.
  • No waiver. If we do not enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
  • Assignment. You may not transfer your rights under these Terms without our consent. We may transfer our rights and obligations under these Terms to another entity as part of a reorganization, merger, acquisition or sale of all or part of our business, provided that your rights under these Terms are not reduced.
  • Notices. We may send you notices in the app, by email if we have your email address, or by publishing them on our website.
  • Language. These Terms are written in English and may be translated into other languages. If there is any inconsistency between a translation and the English version, the English version prevails, to the extent permitted by applicable law.

16. App-specific terms

The terms below apply in addition to the rest of these Terms, only when you use the app concerned.

Noota

Important — recording other people. In many countries and states, the law requires that everyone being recorded is informed and, in many cases, gives consent before a conversation, meeting, call or lecture is recorded or transcribed. Schools and workplaces may also have their own rules. Before you record or transcribe anyone, you confirm that you have obtained every consent, notice and authorization required, including from speakers, teachers, schools and employers where applicable. You are solely responsible for complying with these rules. Noota does not monitor, verify or enforce consent.

  • Imported content. When you import content from a third-party service, such as a YouTube video, you are responsible for complying with that service’s terms and with the rights of the content’s owner.
  • Guest accounts. If you delete the app, reset your device or sign out before linking a guest account to Apple or Google, you may lose access to it and its notes. Link your account so that you can always sign back in.
  • Transcripts and AI Output may attribute statements to the wrong person or contain information that is not in the source. Check them before relying on them.

Tempus

  • Not medical advice or treatment. Tempus is a planning tool designed with ADHD in mind. It is not a medical device, and it does not diagnose, treat or replace professional care for ADHD or any other condition.
  • Focus blocking. Focus sessions rely on Apple’s Screen Time. Blocking can be interrupted or bypassed — for example by changes to Screen Time settings, device restrictions or system updates — and we do not guarantee that it will hold.
  • Reminders and alarms depend on your device, its settings and the operating system. We do not guarantee that they will be delivered, or delivered on time.
  • AI-drafted plans are suggestions. Review them before you save or follow them.
  • More detail: Tempus’s own Terms of Use cover AI-drafted plans, focus sessions, alarms and Tempus Pro in greater depth.

Risen

  • Alarm reliability. Risen uses Apple’s alarm system and is built to wake you, but we cannot guarantee that an alarm will sound, or sound on time. An alarm may fail if your device is switched off, out of battery, restarting or updating, if its sound settings or Focus settings prevent it, or if the system interrupts it. For anything important, set a backup alarm.
  • No emergency or safety-critical use. Do not rely on Risen where a missed or late alarm could cause harm — for example to take medication, to care for someone or for safety-critical work.
  • Physical activity. Some missions ask you to walk, squat, do push-ups, dance or move around. Only do activities that you are fit to do, in a safe space, and stop if you feel pain, dizziness or discomfort. If you have a health condition, ask a doctor first. You take part in these activities at your own risk.
  • Not medical advice. Risen is not a medical device and does not diagnose or treat sleep disorders or any other condition.
  • Mission checks run automatically and can occasionally fail to recognize a correct attempt. Every alarm can be stopped in the ways shown in the app.

Mona

  • Not financial advice. Mona helps you keep track of your own money. “Safe to spend”, daily amounts, projections and insights are estimates based on what you enter. They are not financial, investment, tax or legal advice, and Mona is not a bank, a financial adviser or a regulated financial service.
  • Your figures. Mona does not connect to your bank. Recurring charges it detects and amounts it reads from what you type or scan can be wrong, and amounts in different currencies are not converted. Check your entries, and rely on your bank’s records for anything that matters.
  • Backups. Keep your own backups. An encrypted backup cannot be restored without the password you set, and we cannot recover it.

Visty

  • Age. Visty is intended for people aged 16 and over.
  • Other people’s information. The cards you scan contain other people’s personal data. You must have a lawful reason to collect and use it, and you are responsible for complying with data protection, marketing and anti-spam laws when you store, export or use it to contact people.
  • Shared card pages. When you share your card, the details you include can be seen by anyone who has the link. Only include what you are comfortable sharing, and turn the link off when you no longer want the page to be available. Replies sent through your page contain the personal data of the people who send them; use them only to get back in touch.
  • Exports and integrations. Exports, API keys, webhooks and Zapier send data wherever you tell them to. Keep API keys private: anyone who has one can read your cards. You are responsible for those destinations and for what happens to the data there.
  • Caller ID. The Caller ID list holds the people on your cards and is stored in your device’s contacts, where other apps with access to your contacts may be able to read it.
  • More detail: Visty’s own Terms of Use cover card pages, replies, the tools on visty.app and integrations in greater depth.

Folda

  • Identity documents. Only scan, copy or share identity cards, passports and other official documents when you are allowed to. Copies made with Folda are not certified or official copies.
  • Redaction permanently covers the selected area in Folda’s copy of a document. It does not change copies you have already shared, exported, printed or backed up, and automatic detection can miss information, so check the result before you share it.
  • Signatures added with Markup are images of a signature, not verified electronic signatures.
  • Passwords and App Lock. We cannot recover the password of a PDF you protect, so keep it safe. App Lock stops other people from opening the app on your device; it does not encrypt your documents.
  • Recognized text and AI Output — text, names, summaries, answers and expense data — can be wrong. Check them before relying on them.
